A federal indictment unsealed today charges 10 members and associates of the violent Bronxdale/YDS street gang with a years-long racketeering conspiracy that terrorized residents of the Sotomayor Houses in the Bronx, New York, through multiple attempted murders, assaults, armed robberies, and other crimes between 2020 and May 2026. The charges were announced by U.S. Attorney for the Southern District of New York, Jay Clayton, NYPD Commissioner Jessica S. Tisch, and ATF Special Agent in Charge Bryan DiGirolamo, following a collaborative investigation.
Two defendants, Edwin Pozo, also known as “Swerv,” and Seth Colon, were arrested yesterday and today, respectively, and have been presented before U.S. Magistrate Judge Gary Stein. The remaining eight defendants—Modou Touray, Jeremiah Martinez, Jerimiah Morgan, Tyshawn Morris, Damion Elliot, Davon Best Kelly, Nyjah Wynter, and Raekwon King—are currently in custody in other jurisdictions and will be transferred to the Southern District of New York. The case has been assigned to U.S. District Judge Richard M. Berman.
U.S. Attorney Jay Clayton said, “As alleged, the Bronxdale/YDS gang wreaked havoc on the residents of the Sotomayor Houses for years. With this indictment, the NYPD, ATF, and SDNY bring some measure of relief to the Sotomayor Houses residents, and the members and associates of the Bronxdale/YDS gang will face justice for their alleged crimes.” NYPD Commissioner Jessica S. Tisch added that the defendants "shot a victim in the chest, slashed a rival in the neck, conspired to commit armed robberies of drug dealers, and terrorized the residents at the Sotomayor Houses." ATF Special Agent in Charge Bryan DiGirolamo emphasized that the charges send a clear message that "those who endanger our communities will be identified, investigated, and held accountable."
The indictment alleges that from 2020 through May 2026, the Bronxdale/YDS gang engaged in acts including murder, assault, robbery, drug distribution, and wire and bank fraud across the greater New York City metropolitan area. Specific alleged crimes include Morris and Pozo slashing a rival gang member in May 2021, Morris striking a rival with a metal rod in May 2022, and Touray and Morgan shooting an individual in the chest in September 2023. Additionally, several defendants are charged with conspiring to commit armed robberies of drug dealers and committing a gunpoint robbery of a rideshare driver.
Mr. Clayton commended the investigative work of the NYPD and ATF, also thanking the Federal Bureau of Investigation and the Bergen County, New Jersey, Sheriff’s Office for their assistance. The defendants are presumed innocent unless and until proven guilty, and the prosecution is being handled by Assistant U.S. Attorneys Brandon D. Harper and Jared D. Hoffman.
