The Texas Commission on Environmental Quality (TCEQ) is set to address a comprehensive agenda on June 3, 2026, including numerous permit applications for industrial and waste facilities, alongside a significant number of enforcement actions against companies and municipalities across the state for various environmental violations. The meeting will cover air quality, wastewater discharge, municipal solid waste, petroleum storage tanks, and public drinking water systems.
Among the key permit considerations, Elby's Future, LLC, formerly Devoted Pets Cremations and Memorials, LLC, seeks to renew its Air Quality Permit No. 71793 for a pet crematory in Harris County, which would re-authorize emissions of carbon monoxide, nitrogen oxides, and particulate matter. Motiva Enterprises LLC is applying for initial air quality permits to construct a natural gas turbine cogeneration unit at its Port Arthur Refinery in Jefferson County. Additionally, Flying Bar D Ranch, LTD. has applied for a new permit to discharge treated wastewater in Guadalupe County, and Western Refining Company LLC is seeking renewal and amendment of its air quality permit for facilities in El Paso County. LGS Precast LLC also seeks initial registration for a concrete batch plant in McLennan County.
The agenda also includes petitions for the creation of two new Municipal Utility Districts: The Preserve Municipal Utility District of Collin County by Preserve at Royce City, LLC, and Grove Creek Municipal Utility District of Ellis County by Patrick Road Investors, LP, both requesting additional road powers.
A substantial portion of the meeting will focus on enforcement. The Commission will consider 21 Agreed Orders related to air quality violations, involving companies such as Scout Energy Management, Valero Refining-Texas, Kinder Morgan Crude & Condensate, ExxonMobil Oil Corporation, and Chevron Phillips Chemical Company LP, among others, across various Texas counties. These orders assess administrative penalties and require specific corrective actions.
Furthermore, 14 Agreed Orders address municipal wastewater discharge violations from entities including the City of Corpus Christi, Harris County Water Control and Improvement District No. 84, and several other cities and utility districts. Two Agreed Orders concern petroleum storage tank violations, and ten address public drinking water violations from municipalities and water districts like the City of Electra, City of Marlin, and Somervell County Water District. Two additional Agreed Orders and one Default Order pertain to general water quality violations.
The meeting will also feature a public comment session, allowing citizens to address the Commission on matters within its jurisdiction, with speakers limited to three minutes each. Following the public session, the Commission will convene in closed executive meetings to receive legal advice, discuss pending litigation, and deliberate on personnel matters concerning its Executive Director and other key staff.
