U.S. Immigration and Customs Enforcement (ICE) has lodged a detainer against Moises Domingo Rico Rosales, an illegal alien from Nicaragua, who faces charges of abduction with intent to defile and indecent exposure in Fairfax County, Virginia, after local authorities previously released him despite a prior detainer for drug trafficking.
On June 21, police in Annandale, Virginia, responded to reports of a man exposing himself to a woman on a park trail. Later that day, another woman in the same park reported an attempted abduction, where a man forced her off her bicycle and tried to drag her into the woods before she escaped. Rico Rosales was taken into custody two days later, on June 23.
Rico Rosales illegally entered the U.S. in Arizona in 2022 and was released into the country by the Biden Administration after being arrested by U.S. Border Patrol. He was arrested in 2024 on felony drug trafficking charges, but Fairfax County officials reportedly refused to honor an ICE detainer, leading to his release. Acting Assistant Secretary Lauren Bis said, "This criminal illegal alien exposed himself to one woman in a park and then attempted to abduct another woman the same day. He was previously arrested for drug trafficking in 2024, but Fairfax County sanctuary politicians refused to cooperate with ICE law enforcement and released him from jail."
DHS is now urging Governor Abigail Spanberger and Fairfax County politicians to commit to not releasing Rico Rosales and instead transfer him to ICE custody. Bis added, "This predator was RELEASED by the Biden Administration into our country in 2022. Open border and sanctuary policies have real consequences, and they are the creation of more innocent victims." The department highlighted that Governor Spanberger's executive orders banned state cooperation with ICE and terminated 287(g) agreements, which DHS claims has made Virginia a "hotbed of illegal alien crime."
