The Texas Commission on Environmental Quality (TCEQ) Commission is set to address a comprehensive agenda on July 1, 2026, covering environmental permits, numerous enforcement actions, and petitions for new utility districts and rulemaking.

Key permit considerations include a new Texas Pollutant Discharge Elimination System (TPDES) permit for Mark D. McDonald and Paul D. Smith in Montgomery County, authorizing the discharge of up to 450,000 gallons per day of treated domestic wastewater. Additionally, Concrete Pros Ready Mix Inc. seeks renewal for its Houston concrete batch plant, with no reported changes to emissions. The Commission will also review petitions for the creation of Kaufman County Municipal Utility District No. 16 by Bullhead Energy, LLC, encompassing 1,754.60 acres, and Lakeside Estates Municipal Utility District by Sathish Babu Chakka, covering 722.1 acres in Williamson County, both requesting road powers.

A significant portion of the agenda is dedicated to enforcement actions, with 30 Agreed Orders and two Default Orders under consideration. These orders address a wide array of violations, including air quality infractions by companies such as ISP Technologies Inc., Freeport LNG Development, L.P., and Lyondell Chemical Company. Water quality violations are prominent, with numerous municipalities and entities like Union Carbide Corporation, Shell Chemical LP, and various independent school districts facing penalties.

Further enforcement items cover industrial hazardous waste violations by Highline Warren, LLC, municipal solid waste issues involving the City of Brownfield and Arvell Rabe, and petroleum storage tank violations from FOR FUELS LLC and TA Operating LLC. Several public water systems, including the City of Taft and the Texas Department of Criminal Justice, are also subject to enforcement for drinking water violations.

In a separate matter, Clean Air for Kids and Harris County have petitioned the Commission to adopt new rules. These proposed rules would grant individuals potentially affected by air permits the ability to initiate proceedings for their revocation or suspension. The Commission will also hold closed executive sessions to receive legal advice and discuss personnel matters concerning its Executive Director and other key staff.
