Rochester, NY – John Weinmann, 57, of Rochester, has been sentenced to three years’ probation and a $2,000 fine for knowingly receiving a kickback under a federal health care program. U.S. District Judge Lawrence J. Vilardo delivered the sentence, following an investigation that is part of the Trump Administration’s Task Force to Eliminate Fraud.
As an independent insurance broker between September 2017 and August 2018, Weinmann entered an agreement with a Syracuse company to target Low Income Subsidy (LIS) Medicare beneficiaries. He received $32,150 in kickbacks for recommending and arranging the purchase of medically unnecessary prescription medications, which were then paid for, in whole or in part, by the beneficiaries' Medicare coverage.
The case was prosecuted by Assistant U.S. Attorney Franz M. Wright. The sentencing resulted from a collaborative investigation by the U.S. Department of Health and Human Services Office of Inspector General, the New York State Department of Financial Services, the U.S. Department of Defense Criminal Investigative Service, and the Federal Bureau of Investigation. This effort aligns with the Department of Justice's National Fraud Enforcement Division, which targets fraud against the American people.
