The Texas Commission on Environmental Quality (TCEQ) is set to convene on June 3, 2026, at 9:30 a.m. to address a comprehensive agenda including environmental permit applications, numerous enforcement actions, and the proposed creation of new utility districts across the state. The meeting will cover a range of issues from air and water quality to solid waste management, reflecting the commission's broad regulatory oversight.
Among the key items for consideration are several permit renewals and new authorizations. Elby's Future, LLC, formerly Devoted Pets Cremations and Memorials, LLC, seeks to renew its Air Quality Permit No. 71793 for a pet crematory in Harris County, which would re-authorize emissions of various pollutants. Western Refining Company LLC also seeks renewal for its El Paso refinery's Air Quality Permit No. 18897, covering emissions of carbon monoxide, nitrogen oxides, and particulate matter, among others. New permits include Flying Bar D Ranch, LTD.'s application for a TPDES Permit to discharge treated wastewater in Guadalupe County, and Motiva Enterprises LLC's request for initial air quality and greenhouse gas permits to construct a cogeneration unit at its Port Arthur Refinery. LGS Precast LLC is also seeking initial registration for a concrete batch plant in McLennan County.
The agenda also features petitions for the creation of two new municipal utility districts: The Preserve Municipal Utility District of Collin County by Preserve at Royce City, LLC, and Grove Creek Municipal Utility District of Ellis County by Patrick Road Investors, LP. These districts are proposed under the Texas Constitution and Water Code to manage utility services in their respective areas.
A significant portion of the meeting will be dedicated to considering numerous Agreed Orders assessing administrative penalties and requiring corrective actions for environmental violations. These enforcement actions span various categories, including air quality violations by companies such as Scout Energy Management, LLC, Valero Refining-Texas, L.P., Kinder Morgan Crude & Condensate LLC, and ExxonMobil Oil Corporation. Water quality violations are also addressed, with Agreed Orders against entities like the City of Corpus Christi, Harris County Water Control and Improvement District No. 84, and several other municipalities and utility providers. Petroleum storage tank violations and public drinking water violations by various entities, including the City of Electra and Somervell County Water District, are also on the docket.
The commission will also hold a public comment session, allowing individuals to address matters within the TCEQ's jurisdiction, with speakers limited to three minutes each. Following the public session, the Commission will enter a closed executive meeting to receive legal advice and discuss personnel matters, as permitted by the Texas Open Meetings Act. The meeting will be accessible in person at 12100 Park 35 Circle Building E, Room 201S, and remotely via computer or telephone.
