Tom Cruise And Katie Holmes To Divorce: Lawyer

(Newsroom America) -- Tom Cruise and Katie Holmes are getting a divorce after five years of marriage, according to a statement sent to People magazine by Holmes' lawyer.

"This is a personal and private matter for Katie and her family," said Holmes's attorney Jonathan Wolfe in a statement to People.

"Katie's primary concern remains, as it always has been, her daughter's best interest."

Katie and Tom have a daughter Suri, 6.

It is the third marriage failure for Cruise, who was previously married to actresses Mimi Rogers and Nicole Kidman, with whom he has two children.

Cruise publicist Amanda Lundberg told E! News: "Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children.

"Please allow them their privacy," she said.
